Legal Process Service

The vendor is required to provide that legal process service to facilitate the service of legal documents nationwide for delinquent insurance premiums, claims overpayments, medical assessments, penalties and interest.
- The offeror must have a nationwide network of affiliates available for legal process service and adhere to the rules of civil procedure within each jurisdiction.
- The offeror must have the ability to serve outside the country.
- The offeror must begin service no later than 24 hours from the time of placement unless outside of united states.
- Workforce safety and insurance WSI has the ability to make a priority placement with the offeror with no additional fees.
- The offeror must make multiple attempts with no additional cost to WSI.
- The offeror is required to obtain prior authorization for any additional fees such as mileage and extended placement in addition to the rates established in the contract.
- The offeror must provide WSI with an electronic affidavit of service within ten days from the service date unless outside the country
- The offeror must have in place an operational website that offers a secure online client login for multiple WSI users.
- The website must allow WSI to login with a unique username and password. the client login must allow the transmittal of electronic documents, provide electronic instructions for service, provide functionality to check the real time status of a request for service and have the ability to communicate with the service processor.
- The offeror will define in their response a fee schedule for the legal process services.
- The offeror is required to provide WSI with an operational website that enables secure online invoice payments via credit card.
- This entails establishing a secure platform where customers can view and pay their invoices electronically, ensuring the protection of sensitive payment information.
- Offeror will accept a government credit card without passing the processing fees for the government credit card back to WSI.
- The offeror is required to bill WSI on a monthly basis electronically for the service fees of the completed placements.
- A completed placement is one in which service is complete and the affidavit of service has been received by WSI.
- The offeror must describe their strategies and tools to pursue service.
- The offeror agrees that if any question of law, administrative rule, or wsi process is encountered, the offeror will first contact the collection specialist who made the placement of the request for guidance.
- WSI does not guarantee a minimum number of placements.
- Reports and documentation
• The offeror shall provide WSI with a quarterly report which lists each placement with identifying information including:
1. The number of placements
2. The number of completed services
3. The number of uncompleted services
4. The number of days from the time of placement to service
5. Total fees
- Complaint resolution procedure
• The offeror is required to assist WSI in resolving complaints of harassment, intimidation, false or misleading representation or unnecessary communications filed by the debtor against the offeror’s process.
• The offeror shall notify WSI by letter when a complaint is received against its practices. upon receipt of a Complaint, the offeror shall suspend activity on the placement in question until the issue is resolved.
• No fee shall be paid for activity performed on this placement.
• A justified complaint may also constitute grounds for termination of the contract by the WSI.
• Information furnished to the offeror by WSI is considered confidential in nature.
• While in the offeror’s possession, the information shall be safeguarded and not released to the debtor or any other party without the prior consent of WSI.
• Any unauthorized disclosure of the information constitutes unethical conduct and is grounds for termination of the contract.
