The vendor is required to provide deliver expert employment law advice and representation to the district.
- Employee relations support
• Provide legal counsel on employee discipline, grievances, and personnel matters.
• Advise on compliance with federal and state employment laws, including FEHA, FLSA, FMLA, CFRA, and ADA.
• Assist with workplace investigations, including issues related to discrimination, harassment, and retaliation claims.
• Review and provide recommendations on personnel policies, MOUs, employee handbooks, and internal procedures to ensure legal compliance
- Binding arbitration representation
• Provide representation in arbitration proceedings related to employment disputes.
• Draft legal briefs, arguments, and position statements for arbitration.
• Conduct case analysis and develop strategies to achieve favorable outcomes.
• Negotiate settlements or alternative dispute resolution solutions when appropriate.
- Meet and confer process & collective bargaining support
• Advise and provide oversight for the meet and confer process as required under the act.
• Assist in negotiations with employee associations/unions regarding wages, hours, and working conditions, on an as needed basis.
• Ensure compliance with applicable labor laws and regulations.
• Provide legal guidance on impasse procedures, mediation, and labor contract enforcement.
fact-finding oversight
• Represent the district in fact-finding proceedings related to labor disputes and negotiations.
• Assist in preparing documentation and evidentiary materials for fact-finding panels.
• Provide legal analysis and recommendations based on fact-finding reports.
• Ensure compliance with statutory and regulatory fact-finding procedures

• Legal representation in employment-related litigation.
• Assistance with compliance audits and regulatory investigations.
• Review and advice on evolving employment law and policy changes impacting the agency.
