The vendor is required to provide legal services on behalf of individuals subject to a probate protective proceeding, consistent with mcl 700.5305(3), (4) and mcl 700.5406(5), respectively; individuals subject to a mental health petition, consistent with mcl 330.1454; individuals subject to a petition for appointment of guardian for an individual an alleged developmentally, consistent with mcl 330.1615; and occasional representation where an interested party is not appropriately represented due to minority or otherwise, consistent with mcl 700.1403(d).
- It also includes representation of individuals subject to petitions for mental health treatment.
- Other legal services associated with these areas are required on an infrequent basis.
- individuals subject to a petition for guardianship and/or conservatorship (“respondents”) have the right to object to the petition and appointment of a court-ordered fiduciary.
- The probate court has an obligation to appoint an attorney for the individual in such circumstances should the individual be unrepresented by counsel and/or unable to obtain counsel.
- Services include representation through disposition of the petition(s), and may include multiple court hearings and reviews.
- For petitions to appoint a guardian for an alleged developmentally disabled individual, which derive from the state mental health code, the services include representation of the individual upon the filing of the petition through disposition, which includes a court hearing and may include contested matters and reviews.
- For petitions for mental health treatment under the mental health code, every individual who is subject to a petition (“respondent”) is entitled to be represented by legal counsel.
- The respondents with ability to pay for the legal services in an amount to be determined by the court for payment by the respondent.
- There are additional legal services required on an infrequent basis.
- The services include appointment as a guardian ad litem (gal) or lawyer-guardian ad litem (LGAL) for the following: (1) a deceased estate matters for an unrepresented minor interested party; (2) a deceased estate matter for an unrepresented estate as an interested party (i.e., a predeceased interested party for whom a personal representative has not been appointed); and/or (3) a minor, incapacitated adult, or otherwise legally incapacitated individual as an interested party on a protective proceeding, trust, or other proceeding or civil action before the court, as the court determines appropriate and necessary.
- Provide the number of attorneys who will be assigned to the mental petitions, and the number of attorneys who will be assigned to the guardianship/conservatorship matters.
- The court expressly retains the right to approve, in advance, any attorney who may be retained to provide additional legal services under this provision.
