The vendor is required to provide to act as labor and employment counsel for various matters.
- Law firms may be selected from responding firms based on a thorough analysis of each firm’s ability to provide the district with the highest quality legal services at cost-effective fees.
- The services of a law firm or firms to represent or assist the district, provide advice and render opinions on labor and employment matters
- Legal consultation
• Provide legal consultation to the human resources department, executive leadership team, and the board (or governing body) regarding labor and employment matters.
• Interpret and provide guidance on applicable federal, state, and local labor and employment laws and regulations, including but not limited to title vii, acts law, civil service law, workers’ compensation law, and education law.
• Advise on the development, review, and implementation of personnel policies, employee handbooks, procedures, and administrative regulations. - Collective bargaining and labor relations
• The district currently has nine (9) collective bargaining agreements.
• SERVE as lead negotiator or provide legal support during collective bargaining negotiations with employee unions.
• Review and advise on collective bargaining agreements (CBAS) and memoranda of understanding.
• Assist with grievance and arbitration matters, including preparation and representation at arbitration hearings.
• Provide guidance on labor relations strategy, contract interpretation, and implementation of negotiated provisions.
- Represent the district/agency in state and federal court in matters involving employment law claims, including discrimination, retaliation, wrongful termination, wage and hour, and other employment-related litigation.
- Investigations and disciplinary actions
• Advise on or conduct investigations into employee misconduct, harassment, discrimination, and other personnel issues.
• Provide guidance on due process requirements and progressive discipline.
