The vendor is required to provide legal services, including but not limited to legal counsel and representation; policy development; document review and drafting (e.g., contracts, briefs, legal opinions); negotiations; litigation; legal research; and general advice and counsel.
1. Administrative and governance
• Compliance with the state open meetings act and freedom of information act (FOIA)
• Board governance, elections, and policy development
• General liability and insurance matters
2. Human resources and employment law
• Employee contracts, grievances, disciplinary actions, and terminations
• Unemployment and workers’ compensation claims
• Fair labor standards act (FLSA) compliance
• Matters involving employees
3. Parent and student legal matters
• Student and parental rights, including custody and safety issues
• Student discipline, including suspensions and expulsions
• Issues involving students
4. Special education
• Admission, review, and dismissal (ARD) and section 504 compliance and documentation
• Representation in mediation, due process hearings, and litigation
5. Purchasing, contracts and real estate
• Drafting, reviewing, and negotiating contracts (e.g., construction, services)
• Advising on procurement processes and resolving disputes
• Real estate transactions, including easements and property acquisitions
6. Bond counsel services
• Preparation of election documents and official statements
• Compliance with continuing disclosure and arbitrage regulations
• Liaison with the IRS on bond-related matters
7. general legal support
• Development of policies and procedures
• Legal training and updates for district staff and board members
• Representation in administrative hearings and court proceedings
8. Additional responsibilities
• Advise the board of trustees, superintendent, and administrative staff
• Attend board meetings upon request
• Review or draft personnel policies and employee handbooks
• Conduct legal workshops or training sessions
• Represent the district in legal proceedings before courts and regulatory agencies
9. Fees and billing guidelines
• All legal matters must receive prior written approval from the district
• Attorney-initiated matters will not be billable without prior authorization
• Travel time within the area is non-billable; reduced rates apply for travel outside the area
• Only one attorney may bill for a service unless pre-approved
• Billing must be in increments no greater than 0.10 hours
• All invoices must comply with the district’s billing guidelines
• The district reserves the right to assign matters to firms based on subject matter and expertise.
