The vendor is required to provide legal representation to county in connection with an investigation and potential litigation involving the pharmaceutical companies and pharmacy benefit managers allegedly engaging in unlawful, deceptive, and unfair business practices to artificially inflate insulin prices which have impacted county.
1. Evaluative and investigative preparatory work
• Conduct legal and factual assessments of potential claims involving insulin pricing, overcharges or related anti-competitive pricing.
• Provide recommendations on litigation strategy, including in jurisdictional considerations potential defendants and legal theories.
• Lead pre-litigation investigation including document review, witness interviews, and expert consultations.
2. Draft and argue pleading, motions, briefs, etc.
• Attend all court appearances
• Draft and argue all motions, including any responses, oppositions and procedural motions required throughout the litigation cycle.
3. Conduct and respond to discovery
• Manage all aspects of discovery, including drafting discovery requests reviewing and producing documents, conducting depositions and handling discovery disputes.
• Handle any responses, oppositions and procedural motions required throughout the litigation cycle.
4. Represent county in settlement negotiations
• Engage in settlement negotiations, mediations or other forms of alternative dispute resolution as appropriate.
• Advise on proposed settlements disbursement plans and claims administration if applicable.
5. Maintain excellent client and party communication
• Maintain consistent communication with the county, providing regular updates, risk assessments and budget forecasts, if applicable.
• Coordinate with any co-counsel, joint plaintiffs.
