The vendor is required to provide labor and employment legal services for a wide variety of labor and employment law matters.
- These include, but are not limited to, collective bargaining matters, arbitrations, defense of charges or other litigation, legal opinions and counseling on a variety of labor and employment law topics.
- Labor and employment legal services
• Workers’ compensation: includes coordination with agency staff and third-party administrator, to mitigate and defend contested claims.
• Unemployment compensation: includes representation at various levels of appeal.
• Discrimination: includes the investigation of claims, correspondence with governmental agencies, representation in hearings, resolution of disputes.
• Sexual harassment: includes investigation of claims, investigative conferences, hearings, and resolution of complaints.
• Collective bargaining: includes strategic alternatives and recommendations, development of contractual language, resolution of disputes, advice and counsel pertaining to legal issues.
• Grievances: includes identification of issues, strategic alternatives and recommendations, development of responses.
• Labor arbitrations: includes representation before arbitrators, negotiation of issues, strategic alternatives and recommendations, negotiation of issues and resolutions, etc.
• Labor disputes: includes identification of issues, representation, and advice and counsel regarding legal issues and strategic alternatives and recommendations.
• Labor law: includes local, state, and federal laws and regulations.
• Wages and benefits: include advice and counsel on existing and future wages and benefits at agency and identification and definition of issues.
• Advice on contracts: includes legal requirements pertaining to labor issues.
• Other critical areas: includes areas such as department of transportation regulations, drug free workplace, federal transit administration (FTA) drug and alcohol program, public employee relations act, ADA, FMLA, and CDL.
• ULP: Includes providing counsel and representation for labor and employment-related matters up to and including appearances before commission, the state department of civil rights, state and federal courts or other administrative agencies.
