The vendor is required to provide contingency fee for legal services will include initial case assessment and strategy, recovery and enforcement, and potential litigation management.
1. Case assessment and strategy
• Conduct an initial assessment of the master agreement (MA) and all related loan and incentive documents.
• Identify total amounts recoverable, including loan principal, accrued interest, paid incentives, and contractual damages.
• Identify lienable or encumbered property purchased with state funds.
• Develop and present a comprehensive recovery plan.
2. Collection and recovery efforts
• Prepare and issue demand letters.
• Engage in negotiations and pursue settlements or judgments.
• Enforce liens and other security interests.
• Coordinate all recovery actions with agency.
3. Litigation management
• Pursue and handle all aspects of recovery, including but not limited to litigation, pleadings, motions, defending of counterclaims, discovery, depositions, trial, appeals, and remand proceedings.
• Advance all litigation costs (e.g., expert witnesses, filing fees, travel, etc.).
4. Reporting and deliverables
• Submit an initial assessment and recovery plan within 30 days of award.
• Provide monthly status reports by the 10th of each month detailing updates.
• Submit a final recovery report within 30 days of contract completion.
