The vendor required to provide comprehensive legal advice concerning services to the city to aid in the procurement, selection, and hiring of a progressive design-builder (PDB) firm for the design and construction of an updated civic center.
- The law firm’s services will continue on an as-needed basis through project construction and commissioning.
- Legal advice and counseling concerning the following:
• Advise and assist the city in drafting competitive solicitation documents relating to the city's evaluation and selection of, and contracting with, a PDB firm to design and build the project.
• This advice will include counseling the city concerning the most advantageous means of procuring the PDB firm.
• Assist in the evaluation of qualifications and proposals from potential PDB firms.
• Identify risks posed to the city by the project, including those inherent in the PDB delivery mechanism, and ensure such risks are effectively mitigated in the PDB agreement.
• Negotiate any termination and cancelation rights, renegotiation rights, or contract extension rights.
• Establish the obligations of the city under the PDB agreement, including the structuring of any and all monetary payments by the city.
• Assist and advise the city relative to any and all other legal issues you anticipate may arise in connection with the city's proposal to develop the project via a PDB delivery method.
• Once finalized, assist the city as-needed on implementation and oversight of the PDB agreement through project completion.
