Legal Services

The vendor required to provide legal services for include:
•    Acting as corporate counsel; 
•    Addressing corporate governance matters;
•    Advising on confidentiality, conflict of interest, and ethics issues; 
•    Providing guidance on freedom of information and privacy legislation; 
•    Advising on applicable legislation, including but not limited to the conservation authorities act, conservation land act, residential tenancies act, expropriation act, and others; 
•    Collaborating with various levels of government and public agencies to advance authority revitalization initiatives through agreements, memoranda of understanding, and related instruments; 
•    Preparing reports and providing recommendations to authority management and authority members.
- Local government law:
•    Local government law primarily involves providing legal advice on an as needed basis through written and verbal opinions, bylaw preparation and review, service agreement drafting and review, and procedural guidance related to the authority. 
•    This discipline also includes advising on applicable local government legislation and environmental regulations.
- Environmental law:
•    Environmental law encompasses legal services related to site investigation, site preparation, environmental remediation, and the review and interpretation of records of site conditions. 
•    The firm may be required to develop and recommend risk management strategies to eliminate or minimize environmental liabilities to the authority, its officers and directors, municipal partners, and other public agencies. 
•    Responsibilities may also include providing written and verbal legal opinions, advising on regulatory compliance, and preparing reports and recommendations for authority management and authority members on environmental matters that pose operational, regulatory, or reputational risk.
- Municipal and development law:
•    Municipal and development law encompasses legal services related to the interpretation and application of the planning act, as well as planning and regulatory matters arising through authority development review initiatives. 
•    The firm may be required to represent the authority before the land tribunal (formerly the municipal board), committees of adjustment, and other administrative tribunals. 
•    Responsibilities may also include negotiating with city councils and municipal staff on matters such as precinct planning, zoning by-laws, building permits, and other development-related applications. 
•    The firm will be expected to provide clear legal advice, prepare necessary documentation, and deliver reports and recommendations to authority management and authority members in support of sound land-use planning and regulatory decision-making.
- Employment and labor law:
•    Employment and labor law services involve providing ongoing legal advice and representation within a predominantly unionized environment. 
•    Work in this discipline includes interpreting collective agreement language, advising on best practices within the local government sector, supporting contract negotiations, and offering recommendations related to employee policy development. 
•    Legal counsel may also be required to advise on matters involving both unionized and non unionized employees, including issues related to discipline and discharge, recruitment and selection processes, workplace investigations, and the resolution of labor disputes. 
•    The firm may provide legal representation, guidance, and advocacy for the authority in labor arbitration hearings and related proceedings.
