The vendor required to provide legal services on an “as needed” basis.
- The legal services requested by the named members may include, but are not necessarily limited to, the following:
• Advice and representation in cooperation with the entities named herein.
• Investigation, legal research, drafting pleadings and legal memoranda, and formal representation of the district in administrative hearings and federal and state court.
• Legal advice and representation of the district in litigation on an as-required basis on any or all matters.
• The legal services may be in addition to, or outside of, services normally provided by the district’s in-house legal counsel or the trust, inc., if applicable, and may include but are not limited to:
o Construction disputes
o Employee discipline and termination per district policy and those of the nation
o Employment contracts per district policy and those of the nation
o Employment law
o Federal programs, including title i and Medicaid reimbursement
o First amendment and other civil rights claims
o Governing board authority and liability
o Governing board policies and procedures 9. Immigration
o Insurance contracts
o Intellectual property – copyrights, software use agreements
o Intergovernmental agreements
o Open meeting laws
o Osha compliance
o Payroll issues
o Personal injury and other tort liability
o Procurement law
o Public record laws
o Special education and section 504 of the rehabilitation act
o Statutory and regulatory interpretation
o Student discipline and expulsion
o Taxation – Tero, state, and local sales, use, and property tax
o Workers’ compensation.
• Other required services include all clerical assistance, printing, and duplicating.
• District personnel will be made available, when appropriate, to provide necessary assistance, such as research of historical records or other information needed to perform comprehensive legal services for the district.
• Regular accounting and billing for services and expenses shall be required.
• The organization must agree not to engage in private litigation against the district without first obtaining written permission to do so from the governing board during the effective period of the agreement.
