The Vendor is required to provide many projects which may include, but not limited to, widening of roads and intersections, traffic signals, storm water drainage, and the purchase of whole properties for various county needs.
- The County also acquires fee-simple titles, easements and other various real property interests for reasons including, but not limited to, public parks, wetland mitigation, and conservation easements.
- These acquisitions require title services based on the specific project and reason for acquisition including, but not limited to, title search and examination, title search reports, specific purpose reports, right of way reports, updated title search reports, easement reports, and ownership and encumbrance reports.
- Services include:
• Conduct a comprehensive search and examination of relevant public records to identify the record title holder and all instruments related to the subject property.
• This includes interests, liens, encumbrances, potential encumbrances, clouds, and defects affecting the property's title.
• Provide an accurate closing statement which includes properly calculated property tax proration and ensure accurate distribution of funds upon closing.
• Perform closing services for real property purchases and sales conducted by the county.
• Possess the capability to provide title insurance, if required by the county.
• Independently carry out services requiring professional judgment and those necessitating conclusions or opinions. This encompasses addressing any deficiencies in title reports, without subcontracting, except in cases where a national underwriter is used by a title company.
• Assume responsibility for preparing and submitting all required title reports for assigned parcel(s). Rectify any errors rendering a certified report unreliable within twenty-four (24) hours of county notification, at no additional cost.
• Conduct quality assurance reviews of all reports before submitting to the county. This review should encompass verifying the continuity of the chain of title, ensuring the accuracy of title holder information, and reviewing applicable recorded documents that support the title report.
• Maintain adequate staffing and resources to manage anticipated high volumes (estimated 10-20 searches per month based on historical data) of reports.
• Complete each report within ten (10) business days, unless otherwise specified or approved by the county.
