The vendor is required to provide real estate broker and land acquisition services in compliance with state laws.
- Real estate broker services
• Analyze vacant properties that could be disposed of by sale through either public bid or open market sales.
• Perform a detailed market study to advise how current market conditions affect the sale of properties.
• Conduct a detailed analysis to provide a recommendation of the projected value of proposed properties.
• Prepare a list of all the comparable sites and their asking terms.
• Provide any samples of brochures previously used.
- Administration/analysis/reporting
• Recommend a listing price and provide a comparative market analysis or other valuation method to support the recommended price prior to listing.
• Coordinate real estate appraisals.
• Advise and assist the county in determining the most efficient means of selling to achieve the highest possible market value.
• Submit a marketing plan that includes various types of advertising (listing the property on MLS, FMLS, loop net, social media, and other commercial sites, conducting open houses, providing “for sale” signage, lock boxes, and/or other forms of advertising, including public bidding sites such as govdeals).
• Implement the marketing plan approved by the county, including but not limited to placement, at the agent’s expense, of any advertising materials.
• Advertise the property for sale through open market or by bid.
• Work cooperatively with other real estate agencies and agents to generate interest in the property.
• Solicit written offers for the sale of the property.
• Coordinate site visits/showings with potential buyers.
• Present all submitted offers to the county and, if requested, the board of commissioners.
• Document any accepted offers, counteroffers, addenda, and the like in conjunction with the county’s legal counsel.
• Maintain, complete, and accurate real estate and financial records with respect to all matters and services provided on behalf of county.
• Represent the county in negotiations with a prospective buyer from the time of offer until closing.
• Obtain all written contracts with all necessary signatures to bind a potential buyer to any final agreement.
• Assist the county with all pre-closing, closing, and post-closing matters.
• Maintain copies of any contractor warranty for each related property if one was provided.
• Maintain records of earnest money received, disbursed, and/or returned.
- Land acquisition services
• Assign a project manager or senior real property agent to each task order to provide consultation and management services.
• This role will be responsible for staffing the work and reviewing reports for accuracy and completeness.
• This role will be the final responsibility for quality control.
• Request from the owner any appraisals, surveys, spoil test, etc. that have already been conducted on the parcel(s).
• conduct a market analysis of similar parcels in the area to assist the county in determining a fair offer amount for the parcel(s).
• If there are no recent sales that are similar in nature, make a recommendation to the county to obtain a fair market appraisal.
• Once the county has determined an offer amount, prepare a purchase offer with the county’s desired terms (such as price, amount of earnest money, due diligence period, closing date, and special stipulations, if any); and negotiate in the best interests of the county.
• Negotiate real property acquisitions with landowners, corporations, and/or public utility companies.
• Negotiate for fees, easements, and temporary easements.
• During the due diligence period, assist the county, if needed, with appraisals, collaborate with county vendors to obtain land surveys and soil surveys, etc.
• Serve as holder of the buyer’s earnest money (county to deposit funds via ach transfer.
• Secure a real estate closing attorney, as needed, to facilitate title services and the closing of the transaction(s).
