The vendor is required to provide digital accessibility for state agencies, guide and support the delivery of accessible digital experiences, and provide standardized processes, trainings, and resources.
- Ensure that all AI systems and their outputs provided under the resulting contract, do not and will not infringe upon or misappropriate any third-party intellectual property rights, including but not limited to copyrights, patents, trademarks, or trade secrets.
- Shall indemnify, defend and hold harmless the agency from and against all claims, damages, liabilities, losses, costs, suits, and expenses (including reasonable attorneys’ fees), arising out of or related to allegations of intellectual property infringement or misappropriation caused by the use of contractor’s GenAI systems or the output generated by such systems
- If the GenAI system incorporates pre-existing content, data or materials owned by the contractor or a third party, the contractor must clearly identify such materials in writing and obtain the necessary licenses for the agency to use such materials without restriction or additional fees.
