• The solutions requested in this document process a vast majority of the funds received by the agency and provides a majority of the services offered to our customers, making them paramount in continuing the mission of the agency.

- Delayed initial implementation
• Solution is not operational on agreed upon implementation date.
• Agency may approve extension of implementation date without penalty.
• Supply documentation prior to the implementation date outlining the reasons for moving the implementation date and the potential effect to the agency.
• Penalty and liquidated damages = $500 per day until implemented.
- System performance and availability
• To maximize system availability and performance across all solutions.
• Performance degradation or availability issues within the control of the vendor shall be assessed based on the sales day type and issue severity.
• Recognizes performance and availability issues may be caused by factors outside the control.
• These situations shall be taken into consideration for any performance or availability issue, but the vendor is expected to engage the necessary resources and provide the agency options to address the issue whether in their control or not.
- Penalties and liquidated damages and resolution steps shall include:
• An occurrence is a breach or intrusion affecting 1 or more customers, license agents, or the agency.
• Monetary penalty is incremental based on the data compromised, the number of entities affected, and the resolution time period.
• Penalty amount may be as little as $0 up to $1,000,000 per occurrence.
• Provide credit monitoring services to applicable customers, license agents, and other partners for at least 3 years.
• Communicate breach details and status updates with affected entities by any available method.
• Funds required to safely correct and recover the affected data, solutions, or components.
• $5000 penalty per day patches or updates are not applied and the solutions are not available
