The vendor is required to provide legal services for workers’ compensation on an as-needed basis.
- Services on an on-call, as-needed basis, requesting contractor’s advice, counsel, and assistance on workers’ compensation matters.
- Day-to-day direction of litigation services, including requests to perform services for a particular claim, will be provided by agency third party administrator, with oversight by agency and retention by agency of all settlement authority.
- The initial case evaluation must include a summary of the facts and key issues and the anticipated claims handling strategy with estimated dates for achieving key milestones.
- Must create and maintain a claim file.
- Must provide an initial written case assessment to the manager, risk or other agency designee within 20 days of receipt of the claim referral.
- Provide status reports to the manager, risk or other agency designee within 45 days and within 5 days of significant events.
- Significant events include, but are not limited to, the following: receipt of the permanent and stationary report; filing of declaration of readiness to proceed, petition for penalties, and any petition for benefits that may result in penalties if not timely addressed.
- The hearing report must contain the purpose of the hearing and a recommended response to the hearing notice.
- Contract Period/Term: 5 years
