The vendor is required to provide the office property services including the sale and management of seized/forfeited properties.
- Provide services within twenty-four (24) hours of receipt of an assignment throughout every county in the state.
- Other properties may be added on an “as needed, if needed basis” as our cases move through the process of seizure through judgment.
- Real property which presents an unreasonable risk of substantial economic loss to the contractor, his employees, the public or the state due to the known presence of hazardous or toxic substances.
- Residential real property or an operating business premise, if the seizure of the residential real property or business premise for forfeiture included the exclusion of the occupants, owners, or other interest holders from the premises, unless the exclusion was by consent or authorized by law, including but not limited to, pursuant to a court order, whether seizure warrant or otherwise, or upon written statement of an attorney for the office that such exclusion is authorized by law, including but not limited to the existence of exigent circumstances which make unnecessary obtaining an order prior to such exclusion.
- The management of real property:
1. The ability to appraise or provide a broker’s opinion of prospective price
2. The ability to represent the office in negotiating leases and collect rent
3. The ability to maintain monthly inventory and inspection reports
- Property under management shall be held awaiting disposition instructions from the office.
- Unimproved real property which is not being rented or leased shall incur no management expense except the fee associated with a broker’s opinion of prospective price, unless additional tasks are assigned specifically by the office.
- Property assigned to the contractor for management and/or sale shall be maintained in the same condition as when it was assigned by the office, the expenses of which are reimbursable pursuant to this contract.
- Take measures to prevent deterioration of assigned property and shall maintain property to retain its value until disposition.
- Maintaining property includes taking assigned steps to curtail or retard deterioration
- Safeguards shall be established and observed when property is entered by others for maintenance, repair, upgrading, or consignment.
- Sale- when notified in writing by the office that the asset has been approved for sale, the contractor may utilize any commercially reasonable sale method, including multiple listing service, sealed-bid offers, silent auctions, sale at a public location, or advertised no auctioned sales.
- All inquiries received requesting information on purchasing the property and, wherever directed, shall promote its sale to whatever extent appropriate to secure maximum return for the office.
