The vendor is required to provide insurance and risk management services for include:
1. Risk management
• Assistance with its own risk management and ease of access to risk management advice.
• Demonstrate its capability to offer a wide range of insurance products and services to assist the town in meeting the stated deliverables.
• Assisting the town with insurance coverage, policy wording interpretation, contract wording review, insurance certificate review, and additional risk management services including but not limited to, identification of risk exposures, loss prevention, conducting building inspections, calculating building replacement costs for insurance purposes, conducting risk audits and loss control techniques.
2. Claims management
• The town or together with its outside legal solicitors manage most claims that are within its deductible and determined to be non-reportable.
• Certain claims, such as bodily injury claims are reported to its current insurer, irrespective of the assessment of value in order to ensure reporting guidelines are being met.
• The town may still require the services of an adjusting company to investigate and review the claim, and in so doing may consider engaging the adjusting company used by the proponent’s insurer(s) if this appears to be the best option for the town to do so.
• If the claim falls within the reportable to insurer category, notice is provided expediently and the insurer assumes carriage of the claim and if required, external legal counsel is retained in accordance with the claims management agreement.
• Legal and legislative services department continues to monitor the claim and respond to the insurer’s requests.
• The legal department handles nonreportable claims in house but reserves the right to refer non-reportable claims to outside counsel.
• Once a claim file has been opened and acknowledged, information is requested and gathered from various sources through the town’s legal department, a liability assessment and position are determined based on the information provided, and written claim disposition is completed.
