The Vendor is required to provide compliance review services for include:
- Reviewing for ongoing harm arising from the former interim chancellor’s alleged conduct
• A comprehensive review of all known facts related to the former interim chancellor’s conduct, as made available through document review, institutional records, and interviews;
• Identification of any individual(s) who may be experiencing ongoing harm because of the conduct or the institutional handling thereof;
• Assessment of whether any remedial measures, including supportive measures, policy changes, training, structural modifications, or other institutional actions, are warranted and available;
• Specific, actionable recommendations for remediation, where applicable; and
• Identification of any systemic conditions that may have contributed to or failed to prevent the underlying conduct.
- Reviewing the institutional response to the disclosure of that alleged misconduct was consistent with applicable best practices and legal obligations, and whether further institutional response is warranted
• A chronological reconstruction of the institutional response from the initial disclosure of alleged misconduct through the resolution, based on documentary evidence and interviews;
• Evaluation of colleges response against applicable external and internal obligations and best practices,
• Assessment of whether the response afforded appropriate protection and support to affected individuals;
• Assessment of whether the response included appropriate notice, transparency, and accountability measures consistent with obligations to the board and internal and external stakeholders;
• Identification of any gaps, deficiencies, or areas where the response fell short of applicable standards; and
• Specific, actionable recommendations for further institutional response, policy revision, or procedural reform.
- Reviewing whether the process for appointing a permanent or interim chancellor includes sufficient due diligence to mitigate the potential for future similar occurrences
• Assessment of board of regents practices for selecting and hiring interim or permanent chancellors, including but not limited to initial screening of candidates, adequacy of recommendation process and follow up, interviews with candidates, and thoroughness, accuracy, and career-spanning adequacy of background checks.
• Assessment of whether these practices align with or exceed industry standards and reasonably mitigate risk related to future chancellor conduct;
• Specific, actionable recommendations for policy, procedural, or practice reform related to the selection and hiring of interim or permanent chancellors.
