The Vendor is required to provide hearing officer shall conduct a de novo hearing in relation to the penalty notice issued by the municipality as part of the administrative penalty system (APS).
- The hearing officer must be familiar with municipal law and adjudicative processes.
- The hearing officer is responsible for determining whether to affirm, cancel or reduce the penalty.
- The hearing officer also has the authority to extend the time for payment in accordance with the screening and hearing officer by-laws.
- The duties as the hearing officer will include but are not limited to:
• Conducting hearings ensuring equal access, fair treatment and due process for all parties in accordance with the APS by-law and any policies and procedures established by the municipality;
• Giving the parties to the adjudication an opportunity to be heard.
• Render reasoned and timely decisions based on the evidence provided, to affirm, reduce
• Or cancel the penalty notice or to extend the time to pay the administrative penalty that are independent and free of outside influence; provide written decisions with reasons to be provided to the person(s) which requested the adjudication and to the municipality.
• Attend meetings, orientation and training sessions from time to time as required by the municipality (subject to reasonable scheduling constraints).
