The Vendor is required to provide attorney services to aide in the collection efforts of the revenue commission.
- Duties include but are not limited to providing legal advice, filing suits, making appearances in state courts and federal bankruptcy courts.
- Must have ten or greater years of legal experience.
- Licensed practicing attorney in Kentucky, Indiana a plus.
- Must have knowledge of federal, state, and local laws, occupational license tax laws, regulations, and ordinances.
- Ability to electronically file in federal bankruptcy court and state court.
- Payments shall be made pursuant to detailed invoices presented monthly by the firm to and approved by the Commission upon satisfactory progress of the of the services performed.
- Review foreclosure or other suits, check real estate records to protect Commission’s interest in real estate by virtue of liens.
- Review of statutory withholding tax liens.
- Draft and review summonses and complaints for filing suit to collect tax, penalty, and interest. Prepare written discovery requests, schedule and take depositions, and any related trial work. Draft and review motions for summary judgment or default judgment. Review judgment liens, garnishments, and conduct post judgment depositions.
- Respond in writing or orally to any taxpayer inquiry or staff request concerning collection of occupational taxes.
- If a firm is chosen, they shall be expected to sufficiently staff the engagement with personnel qualified to render the professional services as requested.
