The Vendor is required to provide legal counsel will be expected to perform the following duties:
• Board representation: attend all regular monthly board of commissioners meetings held on the 4th Tuesday of the month and special meetings as requested.
• Policy and regulatory review: review and provide legal updates for the admissions and continued occupancy policy (ACOP), administrative plans, and bylaws.
• Lease and contract management: draft, review, and negotiate contracts, inter-governmental agreements, and residential and commercial leases.
• Labor and employment: advise on personnel matters, including disciplinary actions, grievances, and compliance with labor laws.
• Litigation and general counsel: represent the commission in eviction proceedings, HUD compliance reviews, and general liability issues.
• Landlord-tenant proceedings: represent the commission in summary proceedings for possession of premises, including drafting and serving notices to quit, filing complaints, and appearing in court for eviction hearings.
• Grievance hearings: act as or advise the hearing officer during formal tenant grievance procedures to ensure compliance with HUD-mandated due process.
• General litigation: provide defense or representation in civil litigation, including but not limited to breach of contract, personal injury claims on commission property, and fair housing administrative complaints.
• Collections: pursue legal remedies for the recovery of unpaid rent, damages to property, or other debts owed to the commission by former residents or contractors.
