- Create Essential Functions Job Analyses (EFJA) for the CITY that include:
• Core purpose for the position,
• Essential functions which are critical or fundamental to the successful performance of the position,
• Work environment and conditions where the essential functions are performed,
• Listing of skills and abilities an individual must possess to perform the essential functions, and
• The physical and cognitive demands required to successfully perform the essential functions.
- Interactive Process
• Provide comprehensive management of the CITY’s disability compliance responsibilities.
• Manage all or part of the Interactive Process to support the CITY to make sound reasonable accommodation decisions.
• Contact employees requesting or requiring accommodation, obtain needed medical information, or develop an Essential Function Job Analysis (EFJA) – if needed.
• Coordinate and then facilitate the good faith interactive process meeting to support City in making decisions on what accommodations may be reasonable to implement.
• Establish and maintain case files that include records of significant communications between vendor and employees, medical providers, CITY staff, and other applicable parties. Vendor must utilize Human Resource professionals who not only understand Risk Management and California and federal Disability Laws, but also understand how all of these laws and regulations must integrate with the CITY’s existing personnel rules and collective bargaining agreements.
- File Review
• Provide the CITY with trusted and reliable reviews of an employee’s Interactive Process, and advise on the strengths and weaknesses of a file in complying with the FEHA/ADA disability obligations
• Recommend remedies to improve processes, decision making procedures or documentation methods with the goal of reducing or limiting exposure.
• Provide expert testimony for the CITY
• Understand how accommodation decisions impact due process obligations, and retirement plan regulations for both industrial and non-industrial matters.
- Fitness-for-Duty Case Management
• Review appropriateness of scheduling an examination,
• Identify medical provider,
• Contact the employee, schedule appointments,
• Provide the medical provider with information needed to make assessments on fitness to return to work to the CITY should work restrictions result from the examination,
• Coordinate interactive process meetings, and
• Document communications with medical provider, City, and employee as part of the interactive process.
