The vendor is required to provide that immigration legal defense fund (ILDF) was created to help and those detained in state with immigration proceedings in order to promote family unity, due process, increase judicial efficiency, and protect civil liberties.
- Included in a future potential grant agreement, and have the necessary skills to successfully meet the ILDF objectives and outcomes.
- Screen individuals for eligibility to ensure they are indigent and reside in and intend to reside in state.
- Document each client’s eligibility to be served under this grant and make such documentation available to office upon request.
- Treat all individuals and clients with dignity and respect.
- Accept cases without regard to a client's likelihood of success or eligibility for immigration relief.
- Support clients with their immigration court proceedings, including but not limited to:
• Meeting with clients,
• Determining the most appropriate immigration relief for clients,
• Preparing court cases and relevant documents,
• Submitting application fees,
• Securing interpreters and/or translators,
• Facilitating necessary medical or psychological evaluations
• Securing experts if necessary to the case
• Navigating clients through court proceedings, and
• Attending court and other hearings.
- Provide representation on all legal matters necessary for protection from removal and detention including legal representation before an immigration agency, immigration court and the board of immigration appeals (BIA) within the department.
- Withdraw from representation if:
• The venue in the case is transferred to an immigration court outside of state;
• The client no longer resides in state; or
• Withdrawal is required by the rules of professional conduct.
- Spend ILDF funds in compliance with section 5.d. funding provisions.
- Collaborate and coordinate with office in the implementation of the ILDF grant.
- Notify office in writing (email is acceptable) within three (3) business days of any changes in staffing including supporting documentation as to the reason for the changes.
- The approved budget above ten percent (10%) between lines to office for approval.
- All programmatic reports in a timely fashion.
- Separate accounting for funds under THE ILDF grant.
- Submit timely and detailed invoices.
- Establish and securely maintain records related to the ILDF.
- Safeguard against unauthorized access to and use of personally identifiable information collected in the administration of the ILDF by any person that is not administering the program including disclosures under the state open records act (CORA), except where necessary to comply with a court order.
- Negotiate terms of an agreement to foster the sharing of data through interviews with vera and office and through inputting data to vera’s safe network database, should the state join the vera institute of justice safe network during this grant term, which is the sole decision of the state, a grantee will agree to negotiate.
- The agreement to share data will not apply to any documents, records, communications or any other information protected by attorney-client, attorney work product, HIPAA privacy rules, or any other applicable privilege or non-disclosure exceptions.
