The Vendor is required to provide comprehensive legal services to the agency.
- Services include:
• Initial case review and preparation, to include review of all records, written documents, briefs, exhibits, and agency letter rulings and/or decisions.
• Identification of potential legal errors and arguments in favor of appeal.
• Identification of potential legal issues and arguments against appeal and recommendations to agency staff about pursuing appeal.
• Drafting petitions for relief, to include petitions for declaratory order, petitions for injunctive relief, and all appellate documents.
• Drafting comprehensive appellate briefings outlining the issues, facts, legal arguments, and requested relief (including initial briefs and reply briefs).
• Researching relevant case law, legal statutes, prior agency letter rulings, decisions, and prior determinations.
• Responding to opposing parties’ correspondence, briefs, and arguments.
• Oral argument preparation, including developing key points and anticipated questions for oral argument.
• Attending all hearings as required.
• Communicating with agency staff regularly about status of cases and progress of appeals.
• Prompt response to all agency inquiries.
• Ensuring compliance with all applicable appellate court rules and procedures.
• Meeting all applicable filing deadlines.
• Clearly defining legal issues to be raised on appeal, including any nuances or complexities involved.
• Attending telephone conferences, informal settlement discussions, mediations, prehearing conferences, and post- hearing meetings, as required.
• Outlining potential scenarios and strategies for addressing unexpected situations during the appeal process.
• Establishing clear communication channels and expectations for agency staff updates and decision-making.
• Adhering to timelines set by courts, mediators, opposing parties, and the agency, as required.
• Rendering advice to individual commissioners and agency staff in connection with appeals.
• Providing advice on pia law as it relates to documents that are the subject of appeals under the resulting contract.
