The Vendor is required to provide investigator to perform investigations of complaints received by third part complainants or board-initiated complaints:
• Interview of complainants, licensees and witnesses.
• If requested by the board, interviews shall be recorded and submitted with the investigation report.
• Obtain and review documents, including medical, business, insurance and other relevant records which are the subject of the complaints.
• Inspect medical records, court records and documents, if applicable.
• Preserve and store evidentiary items, materials, and documents in electronic form.
• A status report shall be submitted to the board seven (7) days before each board meeting for the board’s review.
• The status report shall include a list of all assigned complaints; name of assigned investigator; stage of investigation; and, expected date of completion.
• Submit written investigative reports which identify the staff conducting the investigation, interview(s) and final report.
• Investigative reports shall include citations for potential statutory and regulatory violations including specific ethics codes provisions, if any, identified in the investigation.
• Compile case files to present to the board and its subcommittee.
• Work with board counsel on pending litigation.
• Provide testimony for administrative hearings.
• Investigators must understand the licensure laws administered by the state board of licensure for marriage and family therapists, specifically but not limited to chapter 335.300 through 335.399 and 201 KAR chapter 32.
• Attendance at board meeting, if requested.
• Respond within three (3) business days to all communication from DPL staff and board counsel.
• Update the board upon any change in phone number, email address, physical address, mailing address, and staff changes within five (5) business days.
• Submit the final invoice within thirty (30) days of the conclusion of investigative services.
