The Vendor is required to provide third-party administrator (TPA) to provide comprehensive administration of employee leave under the family and medical leave act (FMLA), applicable state leave laws, and related employer policies.
- Shall deliver compliant, efficient, and employee-focused leave administration services in accordance with all applicable federal regulations, including those of the federal transit administration (FTA), department and other governing authorities.
- All services will be in compliance with HIPAA and ADA privacy requirements.
- All services will be implemented in a fair and consistent application of FMLA requirements.
- All contractor FMLA actions and enforcements will be done in compliance with 29 CFR part 825 - the family and medical leave act of 1993, as amended and department of labor regulations.
- Employees who request FMLA certification who are ineligible, based on 29 CFR § 825.110 - eligible employee, will be mailed a completed designation notice by the contractor.
