The vendor is required to provide investigative services related to personnel matters.
• Meet with city staff to develop the scope of investigation
• Assist in identifying factual issues relevant to a particular investigation
• Obtain complaints, written statements or reports from complainant(s)
• Obtain all relevant documents including:
o Written statements of witnesses
o Reports written by complainants, supervisors, managers, and other persons
• obtain copies of all applicable city, policies, departmental policies, and other written policies and manuals
• interview witnesses and the subject(s) of the investigation in a manner consistent with labor laws, city personnel rules, and other legal requirements. investigators may be asked to conduct investigations involving members of the departments.
• Knowledge and familiarity with the public safety officers procedural bill of rights act and the firefighters procedural bill of rights act are required.
• Draft subject and witness notices as requested.
• Obtain other items of evidence
• Assess the credibility of the witnesses and subject(s)
• Digitally record all interviews, if possible, and transcribe recording.
• Regularly communicate with a designated city contact person with updates and progress and other important issues
• Prepare a comprehensive written report for each investigative matter.
• The report shall provide the following: (1) an executive summary of the allegations and the findings, (2) the methodology used, (3) a discussion of the evidence obtained, (4) an explanation of how credibility issues were resolved, and (5) a detailed list of findings from the investigation.
• The comprehensive written report shall not reach any legal conclusions, analysis of any claim or defense, or make recommendations for discipline.
• The city is solely responsible for providing the legal analysis and advice necessary to respond to the investigative report.
• Provide finalized report and supporting documentation through a secured file sharing service with security features (ex: login credentials).
• Testify in court and administrative proceedings in a manner that effectively and concisely presents the relevant information consistent with the evidentiary rules of that forum.
