The vendor is required to provide legal services in a broad range of practice areas.
- Assignments may include but are not limited to: policy development; review and drafting of various legal documents, briefs, memoranda or opinions; negotiations; litigation; research; advice and counsel; and other related duties requested by the authority.
• Municipal law: statutory review, construction and analysis; open records and open meeting laws; ethics requirements and counseling; and intergovernmental agreements
• procurement law: public competitive procurement requirements and the authority’s minority and Woman owned business enterprise utilization program.
• Construction and commercial law: construction and development contract drafting and negotiation; construction and development finance; performance bonds; insurance products and professional liability; contractor claims and payment disputes, mechanics liens, construction mediation and litigation.
• Utilities: experience with the gas and electricity markets, pricing, regulations, and contractual requirements.
• Tort defense: personal injury, premises liability, third-party criminal liability defense, and third-party insurance issues.
• Employment and labor: employment litigation, local, state and federal; training, employment audits and compliance reviews; human resource advice and counseling; labor relations and collective bargaining negotiation, contract drafting; arbitration, mediation, unfair labor practice defense; and immigration.
• Personnel compensation and employee benefits: health insurance; defined benefit, defined contribution and deferred compensation plans and plan administrators; executive compensation.
• Intellectual property and information technology: trademarks and copyrights; technology use, data privacy, encryption, cybersecurity, negotiation of SaaS licenses and other it contracts.
• Real estate: real estate transactions, including acquisition and sale of real property; title; licenses and leases; zoning issues; eminent domain proceedings; environmental matters; development issues.
• Taxation: expertise in state and local taxation, property taxation, sales and use taxes, amusement taxes, tax compliance, tax litigation.
• Commercial transactions: negotiable instruments; banking relationships; performance guarantees; representing the authority as a creditor in bankruptcy proceedings.
• Intergovernmental relations: lobbying; permitting; business licenses.
• Municipal finance: municipal finance, including bond finance transactions and tax-exempt status for public entities.
