1. Assist and support agency to establish a comprehensive and practical framework for the governance of artificial intelligence across the system including:
• An AI solution vetting and approval process
• Transparency standards
• Clinical validation and safety checks
• Risk classifications and escalations
• Data governance, privacy and security considerations
• Recommend organizational structures and workflows for implementation and oversight, including ethical review and equity assessments
2. Educate stakeholders on AI fundamentals, risks and ethical implications in healthcare including:
• Basics of AI in the healthcare setting
• Risks of AI in healthcare
• Clinical safety and quality impacts
• Responsible procurement and implementation of AI
3. Assist with the development and review of legal contract language to address risk, compliance, and intellectual property related to AI technologies by crafting standard AI contractual clauses addressing
• Liability and indemnification for AI related harm
• Vendor responsibilities for transparency, bias mitigation, and model updates
• Data ownership and de-identification safeguards
• Regulatory compliance and notification of adverse events
• Ongoing monitoring, audit rights and termination clauses
4. Ongoing consulting services
• Remain on panel to provide updated legal and governance advice as the regulatory and technological framework for AI changes.
