Legal Services

Attorneys will be assigned to provide representation in all aspects of pre-litigation and litigation related to assigned civil matters in state and federal courts, including but not limited to:
1. Conduct appropriate factual and legal investigation of claims under the attorney-client privilege and provide written reports of the investigations and recommendations to Office.
2. Provide a timely initial assessment, recommended approach, staffing plan, budget, and cost estimate upon OJA request.
3. Conduct research and draft pleadings, motions, briefs, memoranda, correspondence, and other legal work products.
4. Communicate and coordinate with Office as directed throughout the course of an assignment.
5. File and respond to motions and other pleadings.
6. Conduct appropriate discovery including e-discovery and document and privilege reviews and provide required written documentation thereof to Office.
7. Engage appropriate experts, consultants, and litigation support services.
8. Negotiate with opposing counsel within the limits Office authorizes.
9. Appear on the Judicial Branch's behalf at hearings, trials, settlement conferences, administrative proceedings, and all forms of alternate dispute resolution proceedings including mediations.
10. Prosecute and defend the Judicial Branch in appeals.
11. Take all appropriate steps to collect or enforce any recovery, injunctive relief, or settlement that may be obtained and/or negotiated.
12. Pursue, defend, collect, and enforce judgments, attorneys’ fees, expenses, injunctive relief, costs as part of any appropriate claim and/or settlement, and any other courtordered relief.
13. Provide pre-litigation legal advice, analysis, and written recommendations.
14. Provide legal services in any other legal matters in which OJA determines outside legal representation is necessary.
