RFP Description

The vendor is required to provide for city attorney services (excluding those identified by the state code (professional services procurement act), which must be a sole proprietorship, partnership, corporation, or other legal entity registered to do business in the state with demonstrated competence, qualifications, and considerable experience.
- Fees and rates are requested is divided into four categories: general representation, special projects, litigation, and prosecutor.
- Services include:
• Representing and advising the city as city attorney in legal matters.
• attendance at all city council meetings, currently two every month on the second and fourth Tuesdays of each month, one meeting in November, and one meeting in December with each meeting beginning at 6:30 pm until adjourned.
• attending city council occasional special-called meetings, the economic development corporation, the planning & zoning commission, city charter review committee, capital improvement advisory committee (CIAC), and other boards and commission meetings, as needed.
• Being intimately familiar with the city's charter, code of ordinances, applicable state and federal laws, and other applicable documents (such as the city personnel policies and procedures, uniform development code, building and fire codes, and similar codes).
• Attendance at council sub-committee meetings as scheduled and as needed.
• Each sub-committee consists of three councilmembers and is supported by city staff and the city attorney’s office.
• Consultation with city council and city staff via in-person meetings, telephone, and email during normal business hours.
• Attend recurring meetings with city staff during regular business hours, including, but not limited to, the technical review committee (TRC), development and policy review committee (DPRC), and council agenda reviews.
• Serve as the ethics compliance officer for the city’s ethics review board and attend meetings.
• Meetings are held as needed.
• Review and/or draft contracts, resolutions, ordinances, right-of-way license agreements, development agreements, public improvement agreements, inter local agreements, city charter revisions, and other documents as requested by the city council, city manager, or assigned staff.
• Providing a variety of proactive, high-quality, and timely legal opinions and/or advice to the city council and city staff.
• Developing alternative approaches to resolving legal problems.
• Reviewing and making recommendations on a variety of projects and proposals which have legal ramifications.
• Maintaining an appropriate relationship with professional organizations in the field of municipal legal services.
• Staying abreast and informing the city of new or proposed state and federal legislation and legal decisions affecting the city.
• Work cooperatively with special legal counsel retained by the city for special projects.
• Coordinate with other special counsel as needed to ensure proper management of legal issues and proper coordination and transition of legal issues among legal counsel.
• Assist city officials and staff to maintain awareness of ethical standards and appearance of fairness standards, and to avoid potential conflicts of interest, prohibited transactions, and appearance of prohibited transactions.
• Assist city officials and staff to understand the legal roles and duties of their respective offices and interrelationships with other jurisdictions.
• Provide the mayor and city council with guidance as to Robert’s rules of order and related procedural matters relating to council meetings.
• Knowledge of land use laws and related development regulations and the ability of the city to implement and administer such laws and regulations in conformance with state laws and statutes as well as the city council's desire to improve local land use regulations, including providing adequate public facilities.
• Knowledge of state public information and open meeting laws.
