RFP Description

The vendor is required to provide special counsel to effectuate the return of control and ownership of its properties that are low-income housing tax credit (LIHTC) restricted, consistent of the IRS code, at the end of the 15-year compliance periods.
- These public housing sites were redeveloped under the housing and urban development (HUD) and LIHTC rules and regulations, in accordance with federal, state and local laws.
- Include a narrative of issues it has encountered when: negotiating the return to a public housing authority (PHA) of its LIHTC properties; drafting, negotiating and closing HUD mixed-finance transactions, including, but not limited to hope vi and choice neighborhood initiatives transactions, working with executive directors and the boards of commissioners of PHAs, and describing real estate transactions that required legal opinions concerning LIHTC issues.
- Counsel selected should be well-versed in the reporting requirements of PHAs to oversight and regulatory agencies, internal operational guidelines for PHAs, and financial procedures and requirement among a PHA and its subsidiaries, consistent with the HUD, federal, and state and local requirements.
