The Vendor is required to provide individuals or firms to conduct investigations relating to the agencies' investigatory processes and needs, including, but not limited to, supporting the investigation of reports of educator misconduct and human resource investigations, and institutional equity matters aligned with nondiscrimination and title ix compliance.
- Parties and witnesses included in investigations and decisions may include students, employees, contractors, volunteers, and others who may be involved or have relevant information.
- Examples of duties include, but are not limited to the following: investigation of, and/or decision making for, complaints alleging harassment, discrimination, sexual misconduct, and Title IX policy violations.
- Conduct highly skilled investigative assignments, interview complainants and witnesses.
- Work collaboratively with law enforcement, department leadership, the attorney general and members of the attorney general’s office, county attorneys, and other partners. Coordinate with agencies at the local, state and federal levels as appropriate.
- Maintain proficiency in criminal investigation techniques and current case law so that duties and responsibilities are performed in an effective legal manner.
- Control, monitor, and communicate investigative operations, progress and reporting to department leadership, making recommendations for the effective allocation of agency resources.
- Read and interpret legal documents; demonstrate communication skills to support the prosecution of cases before the Commissioner of Education and other formal settings.
- Maintain an accurate, confidential secure file management system.
- At all times, the Investigator will conduct the investigation in a prompt, impartial, and equitable manner consistent with relevant policies and procedures, and where applicable, the time frames for completion of the investigation.
- The investigator will oversee the timely and thorough collection of all necessary documents, statements, and evidence pursuant to policy.
- Provide an investigative plan and a proposed budget detailing the issues to be investigated, witnesses to be interviewed, evidence to be reviewed and/or collected, and an estimated timeline for the investigation.
- Perform a full range of investigative work including but not limited to interviews, inculpatory and exculpatory evidence collection, and review.
- Receive and review all submitted documentation regarding the alleged misconduct in preparation for the investigation.
- Collect evidence, through investigatory interviews, party/witness documentation, and relevant institutional records. Evaluate and categorize evidence relative to applicable policy standards.
- Advice Complainant, Respondent, and witnesses of their rights according to applicable policy prior to commencing an interview. Remind parties of their right to not participate in the investigatory process.
- Participate in live hearings or other resolution meetings, pursuant to policy, that result from investigations as directed by the relevant College office.
