The Vendor is required to provide as-needed legal services on a variety of construction related issues, including but not limited to the following:
• Advise owner on complex legal matters that arise during the construction process, including issues related to procurement, contract award and negotiations, contractor performance, contract monitoring and compliance with applicable laws and regulations
• Review and recommend revisions to owner’s standard public works contract templates, procurement documents, forms and related policies and procedures to ensure they provide optimal legal protection for the agency.
• Review owner’s professional services agreement and provide legal recommendations to strengthen the terms and conditions of these contracts for owner’s protection against design errors, omissions, delays, cost overruns and other risks.
• Advise owner on disputes involving contractual obligations, including but not limited to breach of contract, performance issues, and other claims that may arise between the owner and general contractors.
• Provide legal guidance regarding the advisability of seeking legal recourse for construction defects and other project related issues, and advise on the legal implications of construction defects, warranties, and the owner’s responsibilities in addressing these issues.
• Provide guidance on the process of interacting and invoking sureties and negotiations with sureties in the event the owner needs to address issues such as contractor default or termination and advice on the legal aspects of terminating contracts with general contractors.
• Assist the owner in identifying and evaluating risks associated with its public works projects and provide recommendations and potential mitigation strategies including but not limited to insurance requirements for different project types and delivery methods.
• Adhere to policies and procedures regarding use of confidential data and data collection procedures.
• Preparation of legal opinions, briefs, and reports.
• Representation in hearings and dispute resolution.
• Legal review and compliance with state procurement laws and construction laws.
