The vendor is required to provide professional legal services on an as-needed basis.
- Include, but are not limited to, the following services and requirements:
• Provide legal assistance, support, and representation as determined by the municipality in connection with the recovery of costs associated with per and polyfluoroalkyl substances (PFAS) and aqueous film forming foams (AFFF) damages to the public drinking water system and public wastewater system.
• Identify, quantify, and conduct necessary testing to determine the financial impact of the municipality’s direct, indirect, and intangible losses associated with PFAS and AFFF damages to the public drinking water system and public wastewater system.
• Support the development, filing, and negotiation of claims relating to pfas and AFFF multiple product liability multidistrict litigation actions.
• Engage in mediation and arbitration as required.
• If necessary and appropriate, develop and bring a legal action relating to PFAS and AFFF damages to the public drinking water system and public wastewater system.
• Brief municipal officials, municipal administrators, the municipal attorney, and the governing body on all matters related.
• Provide copies of all claims and litigation correspondence and pleadings produced and received in connection with litigation on behalf of the municipality and give timely written notice to the municipality of all pleadings, dispositive motions, rulings, hearings, trials, mediations, settlement negotiations, and any other legal events relevant.
• Refrain from making any settlement or compromise of any of the municipality’s claims without the municipality’s prior approval.
• The municipality has the absolute right to accept or reject any settlement or compromise.
