The vendor required to provide special legal counsel to members of the board regarding the application and interpretation of the county personnel policies, collective bargaining agreements and state and federal employment law.
• Counsel may be asked to research legal issues and prepare memoranda for the board.
• The county retains separate counsel for collective bargaining proceedings and employment-related litigation and therefore does not anticipate the to include representation in arbitration proceedings or litigation.
• Counsel shall perform all such legal and administrative services as would customarily be undertaken by general counsel to a board such as the board, including but not limited to the following:
o The designated and named primary or designated and named secondary individual from the selected firm or partnership shall attend hearings of the board and render such advice and assistance as required by the board.
o It is of the utmost importance that counsel be available to attend all board hearings at which employees will be represented by counsel they have retained.
o Research legal and factual issues and prepare such opinions, memoranda and reports as requested by the board or the administration support staff of the board.
o Counsel to the board shall advise board members on applicable rules regarding adequate notice, opportunity to be heard, due process, as well as the interpretation and application of relevant statutes, regulations and policies, including state and federal employment law, particularly as it applies to public employers and employees.
