Public Protection Litigation Services

The Vendor is required to provide representation on behalf of the attorney general and the state in litigation for matters brought under one or more of the following areas: consumer protection actions, false claims/fraudulent misrepresentation actions, negligence actions, public nuisance actions, and state and/or federal antitrust, anticompetitive, or restraint of trade actions.
- Services shall include, but not be limited to, provide legal advice and recommendations to the attorney general or his designee, conduct factual and legal investigation of state law and claims; preparing pre and post complaint discovery requests; filing and responding to motions and other pleadings; use of an e-discovery platform to conduct discovery; engage in relevant expert, consulting, and litigation support services; negotiate disputed matters with opposing counsel, including settlement; provide competent and jealous advocacy on behalf of the state in hearings and at trial(s); conduct depositions and handle trial preparation and trial presentation; legal knowledge and possible handling of prosecuting or defending appeals; and taking all appropriate legal steps to collect or enforce any judgment, recovery, injunctive relief, or settlement that may be obtained and/or negotiated.
- The Attorney General or his designee will be actively involved in all stages of any litigation and will have final authority over all aspects of the litigation, including, but not limited to, which claims, if any, to assert and whether and on what basis to settle or proceed to trial.
- May be required to pursue attorneys’ fees and expenses and costs as part of any eligible claim, settlement and judgment.
