The vendor required to provide legal advisement and guidance with respect to a dispute regarding water infiltration and mold presence in prefabricated residential units.
- Such legal advisement and guidance are sought for all prelitigation stages, including but not limited to preservation strategy, coordination of joint inspections, coordinating vendor communications, activity to mitigate damages, identifying and preserving potential claims under a commodities delivery contract, advising on bond matters, managing liens if applicable, assessing modular unit code compliance, assisting with insurance claim(s) and assisting in mediation.
- Requirement:
• Review contracts, insurance policies, communications, change orders, other documentation pertaining to the provision of the prefabricated residential units and the manufacturing defects and quality of work thereof
• Provide initial legal advice and guidance on litigation strategy, including identifying and assessing strengths of all claims for defects
• Work with stony brook team on a regular basis regarding preservation, joint inspections, communicating with third parties, including insurance company, and advising on best strategy for preserving all legal claims
• If needed, assist in preparing for mediation, including conducting interviews, research, and other preparatory work.
