The Vendor is required to provide legal services to assist the office with representing the department with civil enforcement matters.
- The lead attorney and one or more other litigation team attorneys are expected to be counsel of record in any legal matter assigned by the office and will have joint responsibility with office attorneys for litigation functions, such as drafting pleadings and motions, conducting discovery, trying or settling cases, and handling appeals.
- The types of legal matters for which Legal Services would be provided are:
• Enforcement matters brought by department under title 19 as original proceedings in district court including temporary restraining orders and injunctions.
• Enforcement matters that are appealed in district court through a review by trial de novo under the act and the state rules of civil procedure.
• Enforcement-related matters such as supplemental and post-judgment proceedings financial assurance and, as required, administrative enforcement matters.
• Administrative litigation with administrative law judges. Experience in administrative law and specific programs covered under Title 19, preferred but not required.
- The litigation team must have a litigation-oriented practice, regularly handle cases in state district courts and under the state rules of civil procedure, including conducting evidentiary hearings subject to the state rules of evidence, and preferably have prior experience representing public entities in litigation matters.
