The Vendor is required to provide legal assistance services to the elderly as outlined in the older Americans act (OAA).
- The priority service legal issues are:
• Income/nutrition/other benefits: social security, SSI, food stamps, workers compensation, veterans benefits, heap, unemployment
• Housing/utilities: tenant issues, foreclosure, home repair fraud, utility shut offs, energy issues, home ownership, real property, home equity conversion.
• Health/long term Medicare, Medicaid, nursing home, adult home, insurance, home health care cobra, QMB.
• Guardianship/abuse/neglect: defense of guardianship, representative payee, abuse, cases, financial exploitation.
• Consumer: contracts, warranties, tax loans, collection, non-health insurance issues
• Other categories: Americans with disabilities act, grandparents rights
• Planning/preventative action: powers-of-attorney, health care proxy, living wills or to discuss Medicaid planning.
- Legal assistance program does not assist with divorces, criminal issues, fee generating (e.g., suing for one million dollars), bankruptcy (although advice and referral on debts and collection agency issues are allowed).
