The Vendor is required to provide providing comprehensive subrogation legal services, which may include, but are not limited to:
• Reviewing all claims submitted to department to identify potential subrogation opportunities.
• Advising department on the viability and best method for pursuing subrogation claims.
• Evaluating facts, liability, damages, and recovery potential.
• Providing legal opinions regarding subrogation rights and strategy.
• Issuing demand letters and negotiating pre-suit settlements.
• Initiating litigation to enforce subrogation rights including, but not limited to, drafting and filing pleadings and motions, conducting discovery and depositions, and appearing in court.
• Representing the department at trial, arbitration, or mediation.
• Coordinating with internal claims staff and third-party administrators
• Developing a cost-effective strategy for each claim.
• Performing conflicts checks and promptly disclosing and resolving potential conflicts of interest.
• Managing claims files and reviewing for potential responsible parties and viable theories of recovery.
• Providing timely and detailed status reports.
