The Vendor is required to provide legal services and workplace investigation services on an as-needed basis.
- Objective
• Broaden the pool of vetted outside counsel across key practice areas, reducing reliance on a limited number of firms.
• Establish competitive, transparent fee structures that reflect best value to the district while maintaining quality.
• Ensure continuity of legal support as district needs grow and evolve, including emerging areas where current coverage is limited or absent.
• Identify qualified, cost-effective workplace investigation providers capable of conducting neutral, independent investigations when internal capacity or optics require external engagement.
- Requirement:
• Education law: general education law representation, including student discipline, special education, title ix, public records, open meetings, and school board governance.
• Employment law: employment law matters including hiring, termination, ADA accommodations, FMLA, wage and hour compliance, and general employment disputes.
• Public sector labor law: collective bargaining, grievance arbitration, unfair labor practice proceedings, and labor relations strategy in a state public entity context.
• Workers' compensation: defense and management of workers' compensation claims, including litigation support, claims strategy, and coordination with the district's risk management function.
• Discrimination, SAM, and insurance coverage: representation in discrimination matters (employment and student-related), anti-sexual misconduct and ant harassment matters, and insurance coverage analysis and disputes.
• These areas reflect recent and ongoing activity within the district and are a priority focus.
• General tort and public entity defense: defense in general liability matters including vehicle accidents, slip and fall claims, premises liability, constitutional torts, and other tort actions involving the district as a public entity.
• Real estate and facilities law: real property transactions, easements, boundary disputes, facilities-related legal matters, and construction law.
• Environmental and regulatory compliance: representation and counsel on environmental regulations, OSHA compliance, hazardous materials matters, and related regulatory compliance issues.
• Immigration law: employment-based immigration matters for staff, visa and work authorization issues, and compliance with federal immigration requirements.
• Employee benefits law: counsel on health and welfare plan compliance, ERISA, aca, benefit disputes and arbitration, and related employee benefits matters.
• Tax law: guidance on payroll tax compliance, tax-exempt status, and related federal and state tax matters affecting the district.
• Complex contracts, commercial and business disputes: negotiation and review of complex commercial agreements, vendor disputes, and business litigation matters not otherwise covered by the categories above.
• Bond counsel: municipal bond issuance, continuing disclosure obligations, bond compliance, and related financing matters.
• Labor law: collective bargaining, construction and application of negotiated agreements, grievance procedures, and labor arbitrations,

• Investigation of complaints involving employee misconduct, harassment, discrimination, retaliation, and related matters.
• Neutral fact-finding investigations with documented findings and recommendations.
• Preparation of written investigative reports suitable for use in HR and legal proceedings.
• Post-investigation consultation and debrief services as requested.
• Coordination with district legal counsel and HR as appropriate.
