The Vendor is required to provide general counsel legal services and invites interested law firms with experience representing public wastewater authorities, water and sewer related joint powers agencies, retail water and sewer agencies or other public providers that manage service in cooperation with other agencies to submit a written proposal to serve as authority contracted general counsel.
- Requirement:
• Advise the board of directors, general manager and authority staff on, and provide legal services related to, matters of law and equity of importance to public wastewater service
• Physically attend all board meetings (typically one per month) and, when requested, committee meetings (typically two or three per month).
• Review draft agendas for information regarding these meetings;
• Attend and participate in other meetings as requested by the authority.
• The authority’s discretion, video or telephonic participation may be acceptable;
• Prepare budgets applicable to specific legal work and maintain a focus on the authority’s legal budget, advising the authority of projected cost exceedances in advance;
• Provide consultation on and prepare required legal notices, as requested;
• Prepare and review ordinances, resolutions, contracts, real estate agreements, joint powers agreements, and other agreements proposed to be entered into by the authority;
• Research and interpret laws, court decisions and other authorities and provide legal opinions to advise the authority on legal matters pertaining to the authority and its activities;
• Research and submit legal opinions on various matters, as requested by the authority
• Review and analyze proposed or enacted state and federal legislation and regulations and judicial decisions, which could affect the authority.
• Develop and facilitate implementation of a proactive legal strategy to better position the authority to meet its legal, regulatory and policy objectives;
• Promptly return all phone calls and emails from the board of directors and authority staff.
• Quickly obtain a heightened familiarity with the authority’s legal needs and day-to-day operations.
