The Vendor is required to provide legal services for include:
- Student services and related legal services
• Legal advice and consultation related to k–12 instructional programs, operational student services matters, and general compliance with applicable local, state, and federal laws and regulations.
• Legal advice and consultation related to student discipline; title ix compliance; bullying and harassment; student residency and enrollment disputes; athletics eligibility; student records and privacy (FERPA); civil rights matters; and other student-related legal issues arising within a k–12 public education setting.
• Legal representation and consultation in connection with student disciplinary hearings, residency appeals, and other student-related administrative proceedings involving.
• Legal representation and litigation services in student-related disputes arising under state and other applicable laws, including matters involving student discipline, residency and enrollment, civil rights claims (including title ix), bullying and harassment, and other student-related disputes.
• Legal defense and representation in claims and disputes involving student-related matters, including civil rights claims, student injury claims, and claims arising from student services or district operations.
• Services may include claim evaluation, defense strategy development, risk mitigation, negotiation, and resolution.
• Legal representation and litigation management support in student-related matters before state and federal courts, administrative tribunals, and other adjudicative forums.
- Special education and section 504 legal services
• Legal advice and consultation related to special education law, including compliance with the individuals with disabilities education act (idea); development, implementation, and review of individualized education programs (IEPS); eligibility determinations; least restrictive environment (LRE) requirements; and provision of a free appropriate public education (FAPE).
• Services may include guidance on operational issues, parent communications, and best practices intended to support compliance and reduce the risk of disputes.
• Legal advice and consultation related to section 504 of the rehabilitation act and the Americans with disabilities act (ADA), including development, implementation, and review of section 504 plans; disability determinations; accommodations; investigations; and dispute resolution. Services may include guidance regarding compliance with applicable federal and state laws and assistance responding to complaints, audits, and investigations by oversight agencies, including the office for civil rights (OCR).
• Legal advice and consultation related to the review, development, and revision of district policies, procedures, forms, and practices to support compliance with special education and section 504 requirements.
• Legal advice and consultation related to student records, confidentiality, and privacy requirements, including the family educational rights and privacy act (FERPA), as they relate to special education and disability services.
• Legal advice and consultation regarding discipline of students with disabilities, including manifestation determination reviews, suspensions, expulsions, removals, and compliance with idea and section 504 disciplinary requirements.
• Legal advice and consultation related to parent complaints, grievances, and disputes, including informal resolution efforts, facilitated IEP meetings, mediations, and other dispute resolution processes.
