General Counsel and Legal Services

The Vendor is required to provide general counsel and legal services for include:
1. General Counsel services
• Serve as primary legal advisor to the board of education and district administration
• Attend board of education meetings as requested and advise on agenda items and official actions
• Draft, review, and advise on board policies, resolutions, and contracts
• Ensure compliance with law and act
2. State school finance and education law (core requirement)
• Colorado school finance act and annual school finance legislation
• Tabor compliance, mill levy overrides, and bond and election law
• District budget review and fiscal compliance under state law
• Charter school law and authorization under title 22
• Department regulatory compliance and state board rules
• Special education law (idea, section 504) as applied in state public school settings
• At-risk and English language learner funding requirements
3. Employment and labor law
• Employment matters including hiring, discipline, termination, and due process
• Classified and licensed employee contracts and grievance procedures
• Title vii, ADA, FMLA, and state anti-discrimination law compliance
• Collective bargaining and employee relations as applicable
4. Student matters
• Student discipline, due process, and expulsion hearings
• FERPA compliance and student records
• Special education eligibility disputes and due process proceedings
• Student civil rights and constitutional matters
5. Contracts and procurement
• Review and negotiate vendor, construction, and service contracts
• Advise on public procurement requirements under state law
• Real property matters including acquisition, leasing, and easements
6. Litigation and dispute resolution
• Represent the district in administrative proceedings and litigation as needed
• Advise on risk management and liability mitigation strategies
• Coordinate with the district's insurance carriers as required.
