The vendor is required to provide from parties capable of providing racquet sports instructional programming and court management services at the center and four (4) additional neighborhood park tennis courts.
- Site designation and scheduling:
1. Site
• The city reserves the right to assign respondents to specific sites as it deems appropriate.
• Respondents must be prepared to develop a project on any assigned site, regardless of their initial preference.
• The city will consider various factors, including but not limited to, respondent qualifications, project experience, financial capacity, and proposed development plans, in making site assignments.
2. Site scheduling
• The provider and the director of the department of parks and community engagement or his/her designee, will agree upon class schedules.
• The provider agrees to submit a proposal of the program’s seasonal and monthly schedule to the department for all classes no less than four (4) weeks prior to the beginning of each session.
- Responsibilities:
• The provider must have and maintain qualifications to teach the course he is hired to teach, maintains the education and required licenses or permits necessary to teach the class and shall continue to maintain such licenses or permits during the tenure of this agreement.
• Although the city shall not control the instructor’s techniques, methods, procedures, or sequence of instruction, the provider will endeavor to comply with the cities and department’s policies and procedures so as not to interfere with their operation, harm or damage the equipment or facilities afforded to provider for his/her class or to otherwise disrupt the other on‐site activities being offered at such public facilities.
• Provider shall be responsible for paying of all taxes and fees as mandated by the city, and federal law.
• Provider shall provide the city with up-to-date financial reports including, but not limited to, debits, credits, and current balance(s) upon request. the city may additional request one (1) or more certified financial reports, from time to time, prepared by a certified public accountant.
• Provider shall submit records concerning attendance information, total registration fees collected, marketing efforts, and satisfaction/survey reports. records are to be separated by camp session in which services were rendered.
• All records and statistics are due no later than the 7th day after the conclusion of the monthly and seasonal session.
• Provider shall be available, at no cost to the city, for consultation with regards to playing conditions and other matters pertaining to the operation of the tennis and racquetball facilities by the city.
• The provider agrees that it shall not discriminate against any person because of their race, color, religion, gender, national origin, physical ability or sexual orientation and agrees to abide by all federal and state laws regarding nondiscrimination.
• The city shall require all participants in the programs to sign a waiver and release of liability with the provider and have signed copies readily available upon the city’s request.
• The provider also acknowledges that he or she is primarily responsible for the conduct of the students in all classes under his or her charge.
• The provider must attain department approval before the release of any and all promotional materials, including but not limited to flyers, brochures, pamphlets, etc.
• The provider shall not promote any privately owned business in a city park/facility or solicit any participant in a city park/facility for any privately owned business
• The provider shall be responsible for the conduct of the students in all classes under their charge.
