The Vendor is required to provide employees' pension and retirement system individual attorneys or law firms with an established practice in employee pension and retirement matters.
- Ongoing advice and counsel regarding, matters affecting the administration of the retirement system, specifically those pension-related matters for which the attorney has been retained.
- Counsel will be expected, on an as-needed basis, to prepare vendor contracts relating to the administration of the defined benefit plan and the management of its funds; provide memoranda of advice on legal issues related to administration of the defined benefit plan; prepare administrative findings and conclusions as appropriate for matters before the board; and produce such other related materials as may be requested by the board from time to time.
- The board attorney must be willing to acknowledge and accept a fiduciary role to the retirement system.
- Requirements:
• Attend designated board meetings – typically two per year – and provide such advice and assistance as may be needed.
• Review administrative records and prepare appropriate findings and rulings for the board in connection with administrative proceedings coming before it.
• Represent the board in all administrative and judicial proceedings in which the plan is involved.
• Review and provide advice concerning legal issues related to the plan’s actuarial studies.
• Provide ongoing advice and counsel regarding pension-related state statutes and employee benefits matters generally, including the review and analysis of proposed legislation, rules, or regulations.
• Legal advice, as requested by the board, with respect to matters relating to the plans and their activities.
