RFP Description

The vendor is required to provide assistance in identifying, reporting, preparing, and filing claims for settlements in non-traditional investment-related matters and in investment-related litigation matters other than traditional securities litigation.
- Vendors must be able to identify, monitor, and facilitate participation in a broad range of investment-related recovery efforts, including:
• Non-traditional securities class actions
• Group actions
• Shareholder derivative actions
• Antitrust and other class action settlements
• Sec fair funds and disgorgement plans
• Bankruptcy and other insolvency proceedings
• Other litigation impacting investment recovery other than traditional securities litigation
- Portfolio holdings and confidentiality
• Obtain agency periodic portfolio holdings and trading records directly from its custodial bank on at least a monthly basis and maintain this information throughout the course of the contract, maintaining confidentiality as needed. agency
• Obtain information from agency custodial bank on at least a monthly basis that confirms claim filings already made so the selected vendor(s) can avoid duplicate filings and also ensure new filings are made on behalf of agency when eligible.
• Coordinate with agency custodial bank on at least a monthly basis to determine which claims the custodian intends to file.
• Make a preliminary calculation of the agency investment losses, noting the methodology and transaction data used and the appropriate measure of losses with the claim or action, and calculate the estimated recognized recoverable proceeds.
• Report eligible claims, calculated losses and filing deadlines to agency in a timely manner when the custodial bank does not plan to make a filing and follow directions given by agency regarding filings in compliance with filing deadlines.
• Report eligible claims, calculated losses and filing deadlines to agency in other matters identified by the vendor outside its communications with the custodial bank and follow directions given by agency regarding filings in compliance with filing deadlines.
• Ensure that all monetary proceeds collected pursuant to the filings managed by the vendor are transferred to agency
- Data access and reporting
• Provide agency with interactive internet access to data, analysis, and reports related to claims other than those filed by the custodial bank.
- Personnel and advisory support
• Provide personnel resources that are responsive and available on an as-needed basis to confer with and provide recommendations to agency on eligible claims.
