The vendor required to provide integrity commissioner and closed meeting investigator services for include:
- Integrity commissioner
1. Advisory
• Provide formal written advice upon which a local board could rely respecting the code of conduct governing the ethical behavior of members as well as specific situations as they relate to the application of the code;
• Provide formal written advice upon which a local board could rely respecting other policies and procedures that relate to the ethical behavior of individuals subject to the code of conduct;
• Provide general advice on conflict-of-interest issues relating to the municipal conflict of interest act, understanding that this advice may not be used in defense of allegations related to conflict of interest;
• Provide assistance to the public on matters regarding the conduct of council.
2. Education
• Educate members of local board members on the code of conduct, conflict of interest and integrity at least once per term of council; and
• Provide information to the public regarding the code of conduct and the obligations of local board members under the code.
3. Complaint investigation
• Assesses complaints to determine validity;
• Investigates valid complaints; and
• Reports the results of the investigation to council and the public.
4. Complaint adjudication
• Determines if a member has violated any by-law or policy that governs ethical behavior;
• Recommends appropriate disciplinary measures for individuals who are found in violation of the code of conduct or the municipal conflict of interest act;
• Reports the results of investigations to council.
- Closed meeting investigator
• Conduct investigations from time to time as requested upon receipt of a complaint in respect to a meeting or part of a meeting that was closed to the public to determine compliance with the municipal act, 2001 or the procedural by-law and to report on the results of such investigations.
• After conducting an investigation, to render their opinion as to whether the meeting or part of the meeting that was subject to investigation appears to have been closed to the public contrary to the municipal act, 2001 or procedural bylaw and, in either case, the closed meeting investigator shall report their findings and the reasons for their findings to the municipality and shall make recommendations as they see fit.
